Terms of Service

These Terms of Service (the “Terms”) govern the use of the website norsorganic.com (the “Site”) and the sale of products offered on it. They are concluded between any user or customer of the Site (the “Customer”, “you”) and the seller identified below. By browsing the Site or placing an order, you acknowledge that you have read and accepted these Terms without reservation.

1. Seller identification

2. Purpose

These Terms set out the rights and obligations of the parties in connection with the online sale of cosmetic and skincare products offered on the Site. They apply to the exclusion of any other document. The seller reserves the right to amend these Terms at any time; the version applicable to an order is the one in force on the date the order is placed.

3. Products

The essential characteristics of the products are described on each product page. Photographs and descriptions are provided in good faith but are not contractually binding as to minor variations in appearance. The products are offered for sale while stocks last.

4. Prices

Prices are shown on the Site in United States dollars (USD, $). They are payable in full on the date the order is placed. The seller benefits from the VAT-based exemption scheme (“franchise en base de TVA”, Article 293 B of the French General Tax Code); VAT is not applied unless otherwise stated on the invoice. Any customs duties or import taxes that may apply outside France are the responsibility of the Customer.

5. Orders

The Customer selects the products, checks the order summary, and confirms the order by validating payment. The sale is formed once the seller confirms the order by e-mail. The seller may refuse or cancel any order in the event of an existing dispute, a manifest pricing error, or a reasonable suspicion of fraud.

6. Payment

Payment is made online at the time of the order by the means offered at checkout. Payments are processed by our payment service provider Viva.com (Viva Payments Services S.A.) over a secure connection; the seller does not store your card details. The order will be processed once payment has been authorised.

7. Delivery

Products are shipped to the address provided by the Customer within the timeframe indicated at the time of the order. In accordance with Article L216-1 of the French Consumer Code, where no date is specified, the seller delivers without undue delay and no later than thirty (30) days after the conclusion of the contract. Risk of loss passes to the Customer upon physical delivery of the products.

8. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, consumers have a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to give reasons. To exercise this right, notify us of your decision before the deadline by an unambiguous statement sent to support@norsorganic.com or to the registered office above; you may use the model withdrawal form but this is not mandatory.

Returned products must be sent back without undue delay and no later than fourteen (14) days after notifying us. Return shipping costs are borne by the Customer. The seller reimburses the sums paid, including standard delivery costs, no later than fourteen (14) days after being informed of the withdrawal, using the same means of payment.

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to sealed goods which are not suitable for return for health-protection or hygiene reasons and which have been unsealed after delivery.

9. Legal warranties

All products benefit from the statutory guarantees provided by French law, independently of any commercial guarantee:

  • the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code), under which the Customer has two (2) years from delivery to obtain a remedy and is exempt from proving the lack of conformity for a period of twenty-four (24) months following delivery;
  • the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), which allows the Customer to obtain a price reduction or the cancellation of the sale.

10. Liability

The seller is bound by an obligation of means with respect to the operation of the Site. The seller cannot be held liable for indirect damages or for damage resulting from misuse of the products or from non-compliance with the instructions for use. Nothing in these Terms limits the seller’s liability where such limitation is prohibited by applicable law, in particular with regard to consumers.

11. Intellectual property

All content on the Site (trademarks, texts, images, graphics, logo) is protected by intellectual property law and remains the exclusive property of the seller or its partners. Any reproduction or use, in whole or in part, without prior written authorisation is prohibited.

12. Personal data

Personal data collected is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. For full details of the processing and of your rights, please see our Privacy Policy.

13. Force majeure

Neither party shall be liable for any failure to perform its obligations caused by an event of force majeure within the meaning of Article 1218 of the French Civil Code.

14. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the Customer shall first contact the seller in order to seek an amicable solution.

In accordance with Articles L612-1 et seq. of the French Consumer Code, consumers are entitled to have recourse, free of charge, to a consumer mediator with a view to the amicable resolution of any dispute; the details of the mediator may be obtained on request at support@norsorganic.com. Consumers residing in the European Union may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Failing an amicable settlement, and subject to the mandatory rules protecting consumers, any dispute shall be brought before the competent French courts.
